General Terms and Conditions of Sale and Services of ALCONSULTIC

The present document sets out the general terms and conditions of sale and services (hereinafter referred to as the "General Conditions") applicable to the services provided by ALCONSULTIC.

1. Applicability and Derogation

The client expressly waives their own standard terms and conditions, even if these have been established after the present General Conditions. To be valid, any derogation from these General Conditions must be expressly agreed in advance in writing and signed by an authorised representative of ALCONSULTIC.  

2. Payment Terms

Our invoices are payable within twenty-one (21) working days from the date of issue of the invoice, unless a different payment term is indicated on the invoice or the purchase order. In the event of non-payment by the due date, ALCONSULTIC reserves the right to charge, by operation of law and without prior notice, a late payment interest equal to 10% of the outstanding amount. Furthermore, ALCONSULTIC will be entitled to suspend any execution of its services without notice in the event of late payment.

3. Debt Collection

If a payment remains unpaid for more than sixty (60) days after the due date, ALCONSULTIC reserves the right to engage a debt collection agency. All legal fees and other expenses incurred for the collection will be the responsibility of the client.

4. Withholding Tax

Some countries apply withholding tax on the amount of invoices, in accordance with their internal legislation. Any withholding tax will be paid by the client to the relevant tax authorities. Under no circumstances shall ALCONSULTIC be involved in the costs related to the legislation of the client's country. The amount of the invoice will therefore be due to ALCONSULTIC in full and does not include costs related to the legislation of the country where the client is located.  

5. Obligations of ALCONSULTIC

ALCONSULTIC is committed to implementing all necessary means to provide efficient services within the agreed deadlines. However, its obligations are of means and not of results. Under no circumstances shall ALCONSULTIC be held by the client to intervene as a third party in the context of a claim for damages brought against the client by a final consumer.

6. Complaints Procedure

To be admissible, any claim must be notified to ALCONSULTIC by registered letter with acknowledgment of receipt at its registered office within a period of eight (8) days from the delivery of goods or the provision of services.  

7. Applicable Law and Jurisdiction

All our contractual relations shall be governed exclusively by Algerian law. Any dispute relating to the interpretation or execution of these General Conditions shall be subject to the exclusive jurisdiction of the competent Algerian courts.  

8. Privacy Policy

The privacy policy of ALCONSULTIC governs how we collect, use, store, and disclose the personal information of our clients. This policy is available on our websites: www.alconsultic.com, www.alconsultic.digital et www.alconsultic.org,  

9. No Refund

Unless expressly stated otherwise in a specific written agreement, no refunds will be made for services provided by ALCONSULTIC. However, we are committed to carefully reviewing any issues raised by the client and seeking appropriate solutions where possible.

10. Signature of the Contract Outside of Support/Consulting Session

The signing of a contract with ALCONSULTIC may take place outside of any specific support or consulting session. The terms and conditions of the contract shall prevail over any prior communication.

11. Respect for Online Sessions

As part of the online services provided, the client agrees to adhere to the agreed schedules and terms for the sessions. Any failure to comply with this may result in adjustments to the service provision.

12. Access to the Online Platform

If applicable, access to the ALCONSULTIC online platform will be granted to the client in accordance with the specific terms of the contract. The use of this platform is subject to the associated terms of use.

13. WhatsApp Group for Project Monitoring

In order to facilitate project monitoring, a WhatsApp group can be created for communication between ALCONSULTIC and the client. The use of this group is intended for discussions related to the progress of the project and must be conducted in accordance with the rules of courtesy and confidentiality.

Conclusion

By accepting the services of ALCONSULTIC, the client acknowledges having read and unreservedly accepted these General Terms and Conditions.
